Recently, Palantir Technologies announced a partnership with Anthropic and Amazon Web Services (AWS) to develop a new cloud platform, named Claude, specifically designed for use in U.S. defense and intelligence sectors. This strategic collaboration aims to enhance data processing and analytical capabilities within these critical areas.

Partnership Details

According to the announcement from the three companies, the integration of Claude 3 and Claude 3.5 into Palantir's AI platform will be hosted on AWS. Both Palantir and AWS have secured Impact Level 6 (IL6) certification from the U.S. Department of Defense, which permits them to handle and store classified data at the highest levels of secrecy. This certification is crucial for maintaining the integrity and security of sensitive government information.

A spokesperson for Anthropic revealed that Claude was made accessible to the defense and intelligence community in early October. The U.S. government intends to leverage Claude's capabilities to reduce data processing times, discern patterns and trends, streamline document reviews, and assist officials in making timely, informed decisions while preserving their authority in the decision-making process. Shyam Sankar, Chief Technology Officer of Palantir, stated, "Palantir is proud to be the first industry partner to bring the Claude model into a secure environment."

Regulatory Landscape

Anthropic's approach contrasts sharply with that of Meta, which recently announced that it would open its Llama model for defense and national security applications with specific usage policies. In contrast, Anthropic does not require exceptions to its Acceptable Use Policy (AUP) for Claude, allowing its application in potentially sensitive areas within the Department of Defense, Central Intelligence Agency, and other defense and intelligence agencies.

While Anthropic has delineated certain high-risk use cases in its AUP, it has not explicitly restricted Claude's application in defense and intelligence. The AUP notes that using Claude in sectors such as law, healthcare, insurance, finance, employment, housing, academia, and media raises concerns about public welfare and social equity. When queried about the overlap between the AUP and government applications, Anthropic referred only to a blog post discussing expanded government access to Claude.

Exception Mechanism

In its blog, Anthropic outlined a mechanism for granting exceptions to the AUP for government users, emphasizing that these exceptions are "carefully calibrated to enable beneficial use by rigorously selected government agencies." However, the specific criteria and details surrounding these exceptions remain unclear.

Anthropic also indicated that the current exception structure permits the use of Claude for legally authorized foreign intelligence analysis and early warning systems regarding potential military activities, providing a diplomatic avenue to avert or halt conflicts. However, restrictions related to misinformation, weapon design and use, censorship, and malicious cyber operations continue to apply.
